Through his lawyer Ross C. Goodman, Nick requests injunctive relief so that the court immediately cancels his suspension and orders NSAC not to pursue additional disciplinary proceedings related to the case. The suit further asks the court to immediately convene a hearing to determine the merits of the disciplinary charge made against him.

If he is successful in the process, Diaz says he is prepared to face Carlos Condit "immediately". “On February 7, 2012, the UFC president publicly stated that Mr. Condit agreed to grant me an immediate rematch,” said the fighter. “It is my understanding that the winner of this rematch will be awarded the chance to face Georges St-Pierre, the current welterweight champion. If the summary suspension is lifted, I am prepared to face Mr. Condit or any other opponent immediately,” he added.

Diaz's lawsuit does not seek for the court to review the merits of the suspension because he was caught with marijuana metabolites in the anti-doping test in the fight against Condit at UFC 143. The fighter considers that the NSAC should have already called a hearing to define the It's a shame, given that he is on “temporary suspension” without a fixed term, which would even be unconstitutional. According to the process, NSAC had up to 45 days to set a new hearing. Two months later, nothing has been scheduled. This was the first time an MMA fighter sued the NSAC.
